Project information
Claims and dispute work involves documents that are commercially sensitive and sometimes privileged: contracts, programmes, correspondence, cost records, expert reports. We treat all of it as confidential to the client who provided it.
How we handle it
- Project material is exchanged under a non-disclosure agreement, signed before documents are provided, as described under Our Process.
- Access is limited to the people working on the engagement.
- Material is used only for the purpose it was provided for, and is not reused on another matter.
- Nothing identifying a client, a project or a party is published on this website or in our articles without written permission. Where we describe an engagement publicly and permission has not been given, the parties are not named.
Conflicts
Before accepting an engagement we check whether it conflicts with work we have done for another party. Where a conflict exists we decline, or we disclose it and proceed only with the informed agreement of everyone affected. Our independence is the reason clients retain us, and it is not for sale.
Retention and disposal
Project records are retained for as long as our professional and contractual obligations require, and for any period a dispute may still be brought. After that they are securely destroyed.
Sub-contractors and suppliers
Where a supplier could encounter client material — an IT provider, for instance — they are bound by confidentiality obligations no weaker than our own.
Breaches
If information is lost or disclosed without authority, we will tell the client affected promptly, explain what happened, and say what we are doing about it.
